John Pitts has been charged with first-degree endangering the welfare of a child

Language from Probable Cause Statement: I am aware that C.P. (DOB: XX/XX/2012, three years old) was found lying on a bed in the defendant’s bedroom with a gunshot wound to C.P.’s head.  C.P.’s mother found a Smith & Wesson .40 caliber handgun lying next to the toddler.  We found the handgun in the defendant’s bedroom loaded and without any safety feature on the gun.  The defendant, C.P.’s uncle, told police he had left the loaded handgun underneath his pillow when he got up that morning.  The defendant informed us that C.P. was playing in his bedroom on the bed with the family dog prior to finding C.P. injured with the gunshot wound to his head. 


Upon our arrival we located three additional loaded firearms in plain view in the defendant’s bedroom.  A Remington 12 gauge shotgun was located on the floor near the defendant’s closet with the serial number scratched off.  A .22 caliber rifle was also located on the floor near the defendant’s closet.  A Hi-Pointe .40 caliber handgun was located on a chair on the defendant’s bedroom. 


At the time of this warrant application C.P. is in the hospital in serious but stable condition.
