Burden of Proof: One Man's Fight to Show He’s Innocent

ST. LOUIS (First Alert 4) -- A 1988 rape case in St. Louis hinged on a single eyewitness victim’s testimony of who she saw in a dimly lit alley on a Saturday morning at 5 a.m. She said she thought she had seen the perpetrator in the neighborhood before, and gave the police a nickname.


She picked him out in a photo spread and then an in-person lineup. The cops who investigated said she seemed certain it was him. He was charged with rape and sodomy and put on trial later that year. The victim and two officers testified for the prosecution.
